DMCA Policy

Digital Millennium Copyright Act Notice
Lifeguard Training Headquarters (“Company”) respects the intellectual property rights of others just as it expects users to respect its rights. Pursuant to the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), a copyright owner or their authorized legal agent may submit a takedown notice to us via our designated DMCA Agent listed below.
As an internet service provider operating under the “safe harbor” provisions of the DMCA, Company is entitled to claim immunity from copyright infringement claims for user-generated or hosted third-party content. To submit a good-faith infringement claim, you must provide a written notification containing the following information:
1. Notice of Infringement – Claim Requirements
To be effective, your claim notification must include:
- Signature: A physical or electronic signature of the copyright owner or a person explicitly authorized to act on behalf of the owner.
- Identification of Work: Clear identification of the copyrighted work claimed to have been infringed. If multiple works are covered, a representative list may be provided.
- Identification of Infringing Material: Identification of the material that is claimed to be infringing and that is to be removed or disabled, along with information reasonably sufficient to permit us to locate it. You must provide the exact URL(s) of the webpage(s) in question.
- Contact Information: Information reasonably sufficient to permit us to contact you, including your full legal name, physical mailing address, email address, phone number, and fax number (if applicable).
- Good Faith Statement: A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Important Statutory Warning: Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity on our Site is infringing may be subject to liability for civil damages, including court costs and administrative attorneys' fees.
2. Counter Notification – Restoration of Material
If you believe that your material was mistakenly removed or disabled as a result of an incorrect copyright infringement notice, you may submit a written Counter Notification to our DMCA Agent to request restoration.
Pursuant to 17 U.S.C. Section 512(g)(3), your Counter Notification must contain the following elements:
- Your physical or electronic signature.
- A clear description of the material that was removed or disabled and the precise URL location at which the material appeared before it was taken down.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your full name, physical address, and telephone number.
3. Repeat Infringer Policy
Lifeguard Training Headquarters takes digital piracy and copyright violation very seriously. Pursuant to the safe-harbor requirements of the DMCA, we maintain an internal registry of received notices and enforce a strict repeat infringer policy. We reserve the right to permanently terminate the accounts, posting privileges, or access rights of any user or entity found to repeatedly or flagrantly violate the intellectual property rights of others.

5. Policy Modifications
